President Promulgates Administrative Litigation Laws to Take Effect in September 2012


(Staff reporter) The President promulgated on November 23 2012 the amendments to the Administrative Litigation Act, the Enforcement Law of the Administrative Litigation Act, the Intellectual Property Case Adjudication Act, the Organic Law of the Intellectual Property Court, the Organic Act of the Court, the Organic Act of the Administrative Court, and the Act Governing the Punishment of Violation of Road Traffic Regulations. The administrative litigation procedure will be changed from going through two court levels and two instances to three court levels and two instances. An administrative litigation division will be created in each district court to conduct summary procedure and traffic violation adjudication. The aforesaid amendments and the addition of Article 241-1 of the Administrative Litigation Act (regarding compulsory representation in appeal trials of common litigation procedure) promulgated by the President on May 25 this year (2011) will all take effect in September 2012.

The amendments conducted this time are significant changes in the administrative litigation system. The Judicial Yuan is working out related measures to facilitate the enforcement of the amended regulations.
