Judicial Yuan of R.O.C Is Begining to Build Sentencing Databases on “Dangerous Driving Crime” and “Gun-related Cases” to Minimize Discrepancies over Sentencing


(Staff reporter)Judicial Yuan convened on Nov. 16,2011 a meeting on the “Feasibility of the Content of the Gun-related Case Decision Coding Table”. Presiding over the meeting, Secretary General Lin Chin-fang specifically pointed out that all the efforts court judges made in examination of evidence, confirmation of facts and application of laws would be a total waste and a great pity if inappropriate sentencing aroused public discontent.

In response to the demand from all sectors for fair,crystal and appropriate sentencing, the Judicial Yuan took into consideration the social circumstances and the legal system in Taiwan and established in Feb. 2011 the “Sexual Assault Sentencing Database” to address the public concern toward sex offense cases. The system was officially launched in Nov. 1 to provide court judges with more references when determining the sentencing of sex offenders.

In September, the Judicial Yuan also created the “Sentencing Analysis and Research Team” which initially chose the “Crime of Dangerous Driving” to be the content of the second type of criminal sentencing database. Up till Nov. 15, 17,462 cases of dangerous driving had been coded. Subsequently, in light of the threat of gun-related cases to social order, while the Prosecutor General Huang Shi-ming of the Supreme Prosecutors Office also pointed out at the 3rd Meeting of the Policy Council of Judicial Reform that there was room for improvement in sentencing of gun-related cases, the Judicial Yuan therefore decided to build the third type of criminal sentencing database on gun-related cases and hoped to be able to establish more sentencing databases on various types of criminal offenses to minimize discrepancies over sentencing, ensure that court sentencing could meet the expectation of the public, and achieve the ideal of fair, consistent and appropriate sentencing.
